By accessing and using Spark Apply("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. If you are under 18, a parent or legal guardian must accept these terms on your behalf.

Description of Service

Spark Apply is an AI-powered college admissions preparation platform for students in grades 6–12 and their parents or guardians. The Service includes College recommendations, scholarship discovery, extracurricular guidance, multi-year planning tools, and a parent progress dashboard.

Eligibility & Accounts for Minors

• Users under 13 may use the Service only after a parent or guardian completes our verifiable consent process
• For all users under 18, a parent or guardian must accept these terms on the student's behalf
• Paid subscriptions must be purchased and managed by an adult parent or guardian; minors may not make payment commitments

User Accounts

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

Educational Disclaimers

Spark Apply is an educational preparation tool. You understand and agree that:

• We do not guarantee admission to any college or university, any test score improvement, or any scholarship award
• Our AI provides essay coaching through questions and feedback only — it does not write essays or application content for students, and submitting AI-written work may violate college policies
• We do not diagnose learning disabilities, ADHD, or any medical or psychological condition, and the Service is not a substitute for licensed school counselors, IEP/504 teams, or clinical professionals
• College, scholarship, and deadline information is sourced from public data and may change — always verify critical details with the institution directly
• We do not submit applications or file accommodation requests on your behalf

Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Misrepresent your identity, age, or parent/guardian relationship
• Attempt to gain unauthorized access to our systems or another user's account
• Interfere with or disrupt the Service
• Violate any applicable laws or regulations

Privacy

Your use of the Service is also governed by our Privacy Policy, which includes specific protections for minors' data. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

Content and Intellectual Property

You retain ownership of the content you create, including essays, notes, and goals. By using the Service, you grant us a license to store, process, and deliver your content as necessary to provide the Service.

The Service itself, including all software, design, text, graphics, practice content, and other materials, is owned by Spark Apply and protected by intellectual property laws.

Subscription and Billing

The Service offers a free tier and paid subscriptions. Paid subscriptions are billed in advance on a monthly or yearly basis to the parent or guardian on the account. You may cancel at any time, but refunds are not provided for partial billing periods. We reserve the right to modify pricing with reasonable notice.

Service Availability

We strive to keep Spark Apply available 24/7, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or service interruptions.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI-generated recommendations will be accurate or complete.

Limitation of Liability

To the maximum extent permitted by law, Spark Apply shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including admissions outcomes, test results, or scholarship decisions.
